1. Definitions
1.1 In these Terms and Conditions, unless the context indicates otherwise:
(1) “Order” means any order for our Products placed via our Website, in person, or by phone.
(2) “Products” means baked goods, beverages, merchandise or other items we produce and sell.
(3) “Collection Date” means the date and time selected for you to collect your order, as confirmed by us.
(4) “Website” means thebakersduck.com.au and any associated domains.
(5) “We/Us” means The Baker’s Duck ABN [insert ABN], based in Toowoomba, Queensland.
(6) “You/Your” means the person or entity purchasing Products or using our Services.
2. Provision of Services
2.1 We agree to supply Products to you in accordance with these Terms and Conditions.
2.2 By placing an Order, you agree to these Terms and acknowledge that they form a binding agreement between you and us.
2.3 We reserve the right to refuse service to anyone if we reasonably believe their behaviour or order breaches these Terms.
3. Ordering & Payment
3.1 Orders can be placed online, in store or over the phone.
3.2 Full payment is required at the time of ordering. Orders are not confirmed until payment has been received.
3.3 We accept approved payment methods as listed on our Website. Surcharges may apply for certain payment types.
4. Pricing & Availability
4.1 All prices are listed in Australian Dollars (AUD) and include GST unless otherwise stated.
4.2 Prices and availability of Products are subject to change without notice.
4.3 If a Product is unavailable, we may substitute it with a similar item of equal or greater value.
5. Allergens & Product Information
5.1 While we take care in handling ingredients, our Products may contain or come into contact with allergens including gluten, dairy, eggs, nuts, soy and sesame.
5.2 We cannot guarantee the absence of cross-contamination. Customers with allergies should contact us before placing an Order.
5.3 Product descriptions and images are provided for illustrative purposes and may vary slightly from the finished product.
6. Collection & Delivery
6.1 Orders must be collected during the nominated collection window.
6.2 If delivery is available, it will be subject to delivery zones, timeframes and fees as listed on our Website.
6.3 If an order is not collected within the agreed time and no alternative arrangement has been made, we may dispose of the Products without refund.
7. Cancellations & Refunds
7.1 Cancellations must be made at least 48 hours before the Collection Date to be eligible for a refund.
7.2 Custom orders (e.g. cakes, special catering) are non-refundable once production has commenced.
7.3 Refunds will be processed using the original payment method within a reasonable timeframe.
8. Changes to Orders
8.1 Requests to amend an order must be made at least 48 hours prior to the Collection Date.
8.2 We cannot guarantee changes for orders already in production.
9. Conduct in Store & On Premises
9.1 We expect respectful behaviour towards our staff and customers at all times.
9.2 We reserve the right to refuse entry or service to anyone behaving in a threatening, abusive or unlawful manner.
10. Third-Party Links & Tools
10.1 Our Website may include links to third-party sites or tools. We are not responsible for their content, accuracy or policies.
11. Intellectual Property
11.1 All recipes, images, branding, logos, product designs, and written content remain the property of The Baker’s Duck.
11.2 You may not reproduce, distribute or use our intellectual property without prior written consent.
12. Photography & Marketing Use
12.1 We may take photographs of Products or displays for marketing purposes.
12.2 If your order is personalised, we may share images of it unless you notify us in writing not to do so.
13. Liability & Indemnity
13.1 To the maximum extent permitted by law, we exclude all liability for loss or damage arising from your use of our Products or Services.
13.2 You agree to indemnify us against any claims, damages, or expenses resulting from your breach of these Terms.
14. Force Majeure
14.1 We are not liable for any failure or delay in fulfilling an order due to events beyond our reasonable control (including natural disasters, supply chain disruptions, pandemics or government restrictions).
15. Privacy
15.1 We handle personal information in accordance with our Privacy Policy, available on our Website.
16. Changes to Terms
16.1 We may update these Terms at any time by posting the revised version on our Website.
16.2 Your continued use of our Services after changes are posted constitutes acceptance of the updated Terms.
17. Governing Law
17.1 These Terms are governed by the laws of Queensland, Australia.
